Application of the Code and Standards: Level II
Level II ethics is tested through item sets that mix several people, firms and events, with violations hidden among permitted conduct. This module brings the Standards together into a method: map each person's role and status, separate every action, find the affected party and the most specific Standard, test for permitted exceptions, and then recommend corrective action that actually fixes the problem. Worked cases and a full item set apply the method across all seven Standards.
What you will learn
1. Evaluate the practices, policies and conduct described in multi-party case studies against the Code and Standards.
- Identify each person's role and status; only members and candidates are bound by the Standards.
- Separate every action and note its timing relative to announcements, orders and resignations.
- Identify who could be harmed to find the right Standard family.
- Check permitted exceptions before concluding there is a violation.
- Firm-policy compliance does not excuse a breach of the Standards; read 'most likely' and 'least likely' carefully.
2. Explain why specific conduct does or does not violate the Code and Standards.
- A correct answer needs both the right Standard and the right reason.
- Typical exculpatory facts: public or mosaic information, legal requirement, consent, prominent disclosure, modest value, adequate supervision.
- Disclosure never cures front-running, unfair allocation, unsuitability or trading on MNPI.
- Where the Standards are stricter than the law or firm policy, the Standards govern.
- Intent matters for manipulation and misrepresentation, not for acting on MNPI.
3. Recommend corrective actions and policies that would bring the conduct into compliance.
- Stop the harm first, then escalate to supervisors and compliance.
- Remediate: reallocate, compensate, correct records and communications.
- Disclose to clients where needed and report to regulators where the law requires.
- Fix the root cause with specific policies, training, monitoring and incentive changes.
- The most appropriate answer targets the specific problem; disclosure-only, promise-based or overreaching responses are usually wrong.
Module at a glance
- Map every person's role and status; only members and candidates are bound by the Standards, but supervisors answer for reasonable oversight of everyone.
- Split vignettes into separate actions, note timing, and ask who could be harmed.
- Check permitted exceptions before concluding there is a violation, and never treat a weaker firm policy as a defence.
- The right answer needs the right reason: disclosure does not cure unsuitability, front-running or trading on MNPI.
- Where the Standards are stricter than the law, they govern; intent matters for manipulation but not for MNPI.
- Corrective action: stop the harm, escalate, remediate, disclose or report as required, fix the cause, hold people accountable.
- Prefer targeted, prompt fixes over disclosure-only, promise-based or sweeping responses.
